A Virginia woman is speaking out after her husband of 42 years, 77-year-old Bert Atienza, died following an altercation inside a Walmart that reportedly began over a shopping cart.
According to his wife, Josephine Atienza, the couple had stopped at Walmart after church when a 17-year-old employee allegedly nearly struck her with a heavy cart without apologizing.
Josephine says Bert confronted the teenager, questioning why he did not say “excuse me.” She claims an argument followed, and the employee allegedly threw a can toward the couple as they continued shopping.
Minutes later, Josephine says the teenager’s parents arrived at the store and confronted Bert. She alleges that her husband was struck in the face and kicked after he fell to the floor.
Bert was taken to the hospital but died the following day. His death was ruled a homicide caused by blunt-force head trauma, according to the account.
The teenager’s parents, Erika Mitchell, 42, and Travis White, 44, are facing second-degree murder charges and are being held without bond, while the 17-year-old employee faces assault and battery, aggravated malicious wounding and conspiracy charges.
All allegations are part of an ongoing criminal case, and the defendants are presumed innocent unless proven guilty in court.
