California Enacts Laws to Regulate AI Use in Entertainment

California has taken significant action to regulate artificial intelligence, making it illegal to use AI-generated replicas of an actor's likeness or voice—a critical issue for the industry. Governor Gavin Newsom has signed two bills, AB 1836 and AB 2602, that protect both living and deceased individuals from unauthorized AI manipulation, building on the safeguards established by SAG-AFTRA members during last year's strike. This new legislation removes previous exceptions that allowed AI to digitally replace performers in films and television without the consent of their estates. Now, creating a replica of an actor requires a contract that explicitly outlines consent, addressing a gap in regulations that existed before.
